The Fourth Amendment applies to medical procedures when they are conducted by the government or its agents for the purpose of obtaining evidence in a criminal investigation. The Supreme Court has held that such procedures are searches within the meaning of the Fourth Amendment and must be reasonable under the circumstances. The reasonableness of a medical procedure depends on the balance between the individual’s privacy interests and the government’s legitimate interests in law enforcement. Some questions that this webinar will answer is:
What is the best way to obtain consent for a medical procedure?
If a person provides consent to a blood draw, can they revoke that consent during the procedure?
What is police wanted to retrieve a bullet from a person, could they get a warrant for that procedure?
